正確にはa writ of habeas corpusといいます。この言葉は必須です。オバマ新大統領はGitmo（キューバにあるアメリカのテロリスト専用の収容所で拷問による取調べで有名なところ）の閉鎖を命じました。これにより失墜した民主主義の回復がはかられるかもしれません。habeas corpusは人身保護令状と訳されていますがその意味は誰でも裁判所で公平な裁きを受けられる権利です。おかしいのはアメリカの憲法にはいつでも戒厳令が発令できるようにthe privilege of the Writ of Habeas Corpusと表記されていることです。グアンタナモ・ベイ収容所(Gitmo)にはこれがありませんでした。靴を投げられた大統領は第二次世界大戦中の収容キャンプが違法であったことさえ思い出せなっかたのでしょうか？
